About these terms

These Terms of Service (“Terms”) govern your access to and use of Talon, a macOS desktop application (“the App”) and the website at gettalon.co (“the Website”), provided by Talon (“we”, “us”, “our”). By using the App or the Website, you agree to these Terms.

Beta program

Talon is currently available as a beta product. Access is granted on request and may be limited or revoked at any time at our sole discretion. The beta version may contain bugs, errors, or incomplete features. We make no guarantees about availability, uptime, or continuity of the beta program.

By participating in the beta, you acknowledge that the App is provided in an early stage and may not perform as expected. Features may change, be removed, or behave differently in future versions.

Use of the App

You agree to use Talon only for lawful purposes and in accordance with these Terms. You may not:

• Reverse engineer, decompile, or disassemble the App.
• Use the App to process data you do not have the right to access.
• Redistribute, sublicense, or resell access to the App.
• Attempt to circumvent any access restrictions or security measures.
• Use the App in any way that could harm, disable, or impair its operation.

Your data and privacy

Your use of the App is also governed by our Privacy Policy. Talon processes messages locally on your Mac. When you use a cloud-based AI provider, message content is sent to that provider's API as described in our Privacy Policy.

You are solely responsible for any data you choose to process through the App, including ensuring you have the necessary rights and permissions to do so.

Third-party services

Talon connects to third-party services (Gmail, Outlook, WhatsApp, AI providers) using credentials you provide. We are not responsible for the availability, accuracy, or policies of these third-party services. Your use of these services is subject to their respective terms and conditions.

AI-generated content

Talon uses AI to generate summaries, draft replies, and classify messages. AI-generated content may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and approving any AI-generated content before sending it. We are not liable for any consequences arising from AI-generated content.

Disclaimer of warranties

The App and Website are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant that AI-generated content will be accurate, appropriate, or suitable for any purpose.

Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Talon, its developers, affiliates, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the App or Website.

Our total cumulative liability to you for all claims arising out of or relating to these Terms or the App shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or EUR 100, whichever is greater.

Indemnification

You agree to indemnify and hold harmless Talon, its developers, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

Termination

We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. You may stop using the App at any time by uninstalling it from your Mac.

Sections relating to disclaimers, limitation of liability, indemnification, and governing law shall survive termination.

Intellectual property

Talon, including its design, code, features, and branding, is the intellectual property of its developers. These Terms do not grant you any rights to our trademarks, logos, or other intellectual property. You retain ownership of your data processed through the App.

Changes to these terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Continued use of the App after changes constitutes acceptance of the new Terms. For material changes, we will make reasonable efforts to notify beta participants.

Governing law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Talon operates, without regard to conflict of law principles.
